1. Introduction
This VPS Hosting Policy ("Policy") sets forth the terms and conditions governing the use of virtual private server ("VPS") hosting services provided by ENVIROWEB LTD ("we", "us", "our"). By ordering, accessing, or using any of our VPS services, you acknowledge and agree to be bound by this Policy.
This Policy is intended to supplement, and should be read in conjunction with, our primary Terms of Service. In the event of any inconsistency or conflict between this Policy and our main Terms of Service, the provisions of this Policy shall apply specifically to VPS-related matters.
2. Scope of Service and Responsibility
We provide unmanaged VPS hosting services delivered via third-party infrastructure providers. When you purchase a VPS, the operating system is automatically installed according to your selection during checkout. After provisioning, you may reinstall or change to another available OS using the control panel in your client area.
You, as the account holder, are fully responsible for the management and operation of your VPS environment. This includes, but is not limited to, the following responsibilities:
- Server Configuration: You are responsible for configuring your VPS to meet your technical and operational needs. This includes managing system settings, user accounts, and performance tuning.
- Software Installation and Maintenance: All applications, libraries, and services installed on your VPS must be installed, maintained, and updated by you. We do not provide assistance or oversight regarding internal software configuration or compatibility.
- Security Measures: You must implement appropriate security practices, including—but not limited to—firewall configuration, secure authentication methods, SSH key management, vulnerability patching, and access control policies. You are solely responsible for the security and integrity of your VPS.
- Firewall Management: Through the control panel, you are responsible for configuring, reviewing, and maintaining firewall rules to protect your environment from unauthorized access or misuse.
- Backup and Data Protection: You must maintain regular, complete, and tested backups of all data stored on your VPS. If snapshot functionality is available and selected during checkout, you may use it to create on-demand recovery points—but this should not replace a broader data protection strategy.
- Compliance and Legal Use: You are responsible for ensuring that your use of the VPS complies with all applicable laws and regulations, and that your hosted content and activities do not violate any of our policies available on our website or any applicable third-party rights.
We do not access, manage, or maintain the internal configuration, data, or software of your VPS. You retain full control and responsibility for its operation and security.
Support is available through our ticketing system for the following:
- Billing or payment-related issues
- Service cancellations or renewals
- Issues with client area control panel functionality
For infrastructure or network-related incidents, we work with upstream vendors to investigate and resolve issues as appropriate. We act as a point of coordination in such cases, but we do not guarantee resolution times or outcomes for issues outside our operational control.
3. Provisioning, Billing and Refunds
Each VPS service is provisioned automatically and specifically according to the configuration you select during checkout. This includes your chosen operating system, the inclusion of optional features such as snapshot capability, and any other available service-level customisations.
Provisioning begins immediately after payment is confirmed. These services are fulfilled using non-refundable third-party infrastructure, and the resources allocated to your VPS cannot be re-used or reclaimed once assigned. As such, all VPS purchases are final and non-refundable upon provisioning, regardless of billing cycle (monthly, annual, or otherwise), level of usage, or subsequent account cancellation.
By proceeding with payment, you confirm and agree that:
- You are ordering a service that is custom-built to your specifications and intended for immediate deployment.
- You expressly request that we begin provisioning without delay, and you acknowledge that this action removes your right to cancel under consumer protection law.
- In accordance with Regulation 36 of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and Article 16 of the EU Consumer Rights Directive 2011/83/EU, you waive the standard 14-day right to withdraw.
It is your responsibility to ensure that the selected configuration meets your technical and operational needs before placing your order. No refunds, credits, or transfers will be issued once the provisioning process has commenced, including (but not limited to) cases involving:
- Incompatibility with software or applications
- Misconfiguration during the order process
- Change of mind or no longer needing the service
- Technical issues arising from customer-side mismanagement
We reserve the right to refuse or cancel orders prior to provisioning if there is evidence of abuse, fraud, or non-compliance with our policies. In such cases, a full or partial refund may be issued at our sole discretion.
4. Acceptable Use and Prohibited Activities
You may not use the VPS Services to engage in any illegal, abusive, negligent, or disruptive activity, or in any manner that compromises the integrity of our systems, affects the experience of other users, or violates applicable law or third-party rights. By using the VPS Services, you agree not to host, transmit, or facilitate any of the following:
4.1 Prohibited Content
- Sexual Content & Nudity: Any form of pornographic, sexually explicit, or adult content, including visual, textual, or video media depicting nudity or sexual acts, whether partial or explicit.
- Hate Speech and Discrimination: Content that promotes or incites hate, violence, or discrimination against individuals or groups based on race, ethnicity, religion, nationality, gender, sexual orientation, disability, or any other protected characteristic.
- Violent or Extremist Material: Content that glorifies, incites, or promotes violence, terrorism, animal cruelty, or extremist ideologies.
- Child Exploitation: Any content depicting, promoting, or implying the abuse or exploitation of minors is strictly forbidden and will be reported to law enforcement authorities.
- Defamatory or Harassing Material: Content that defames, bullies, threatens, or harasses individuals, organisations, or protected groups.
4.2 Prohibited Activities and Uses
- Intrusive or Exploitative Behaviour: Intrusion attempts such as port scanning, packet sniffing, spoofing, unauthorised access attempts, and remote code execution.
- Malware and Exploits: Distribution of malware, viruses, spyware, Trojan horses, worms, ransomware, or other harmful software.
- Spam and Email Abuse: Use of the VPS to send mass unsolicited emails, run mail bombers, or host spam-related content. Operation of open SMTP relays is prohibited.
- Illegal Communications: Unauthorised access to systems, denial-of-service (DoS) attacks, brute force tools, or other hostile network activities.
- Anonymisation and Proxy Services: Running public proxy servers, VPN exit nodes, anonymisation services (including Tor relays), IRC servers, or P2P file sharing platforms.
- Crypto Mining and Traffic Schemes: Running cryptocurrency miners, autosurf networks (e.g., Hitleap, Jingling), Black Hat SEO schemes, or artificial traffic generators.
- Copyright and Licensing Violations: Hosting or distributing pirated content, warez, cracks, unauthorised software, or any material infringing intellectual property laws.
- Investment and Financial Scams: Operating high-yield investment programs (HYIP), ponzi schemes, escrow fraud, fake bank debentures, or unregulated trading platforms (FOREX, E-Gold Exchange, etc.).
- Content Mirroring and Storage: Using the VPS as a mirror site, banner exchange, file hosting, image or video storage platform, or cloud storage service (e.g., OwnCloud, SparkleShare) unless explicitly permitted.
- Unacceptable Web Services: Hosting topsites, game servers (e.g., MUDs/RPGs), streaming services, escrow platforms, or hacking/penetration testing tools.
4.3 Enforcement and Consequences
We reserve the right to investigate and take immediate action in response to any suspected violation of this Policy. This may include suspension or termination of the VPS without notice; removal of content; reporting violations to law enforcement or regulatory bodies; or permanent blacklisting or refusal of future service. No refunds will be provided for services suspended or terminated due to a breach of this Policy. Our determination as to whether any activity or content is prohibited is final and not subject to appeal.
5. Backups and Data Responsibility
You are solely responsible for implementing and maintaining complete, regular, and secure backups of all data, software, and configurations stored on your VPS. As this is an unmanaged service, we do not provide any automatic or managed backup solution, and we accept no liability for data loss, accidental deletion, or corruption under any circumstances.
If you have selected the optional snapshot feature at the time of purchase, this enables you to manually create a point-in-time snapshot of your VPS environment. This feature is subject to the following conditions:
- Snapshots are created on demand only by you and are not automated.
- Only one snapshot may exist per VPS at any given time.
- In order to create a new snapshot, you must first delete the existing one via the client area.
- Snapshot creation, deletion, and restoration are solely your responsibility and must be performed through the control panel provided.
Snapshots are intended to provide basic rollback capability, but they should not be relied upon as a substitute for comprehensive backup practices. You are strongly advised to maintain separate, external backups appropriate to your use case, business continuity needs, and compliance obligations.
No additional backup functionality or data recovery assistance is included with your VPS plan.
6. Support Scope and Limitations
VPS hosting services are provided on an unmanaged basis, which means that we do not oversee, maintain, or intervene in the internal operation of your server. As such, our support services are intentionally limited and are not intended to substitute for systems administration or technical consulting.
Support is strictly limited to the following areas:
- Assistance with billing, renewals, and cancellations
- VPS provisioning status and deployment-related issues
- Functional issues related to the control panel provided in the client area
We do not provide support for any of the following:
- Internal server setup, configuration, or tuning
- Installation, maintenance, or troubleshooting of any software, services, scripts, or operating system-level features
- Control panel software (e.g., cPanel, Plesk) installed by you or any third party
- Web server (e.g., Apache, Nginx), database server (e.g., MySQL, PostgreSQL), or mail server configuration
- SSL certificate installation or debugging
- Configuration or debugging of DNS zones outside of rDNS
- Security auditing, intrusion recovery, patching, or vulnerability management
- Performance or availability diagnostics relating to websites, applications, or databases hosted on your VPS
- Monitoring, tuning, or load balancing setup
- User or permission management within the server
- Email deliverability issues or spam filtering
- Malware removal or compromise investigation
- Any third-party service or integration used within your VPS
- Backup restoration or data recovery services
Because this is an unmanaged environment, you are expected to have the necessary technical knowledge—or to engage a qualified server administrator—to manage, secure, and troubleshoot your VPS independently. We reserve the right to decline any support request that falls outside the clearly defined scope above.
7. Termination and Suspension
We reserve the right to suspend, restrict, or permanently terminate your VPS service at our sole discretion, with or without prior notice, under any of the following conditions:
- A breach of this VPS Hosting Policy, our Terms of Service, or any applicable law or regulation
- Engagement in any prohibited activity outlined in Section 4 of this Policy
- Use of the service in a manner that endangers the stability, performance, security, or reputation of our infrastructure, network, other customers, or third parties
- Receipt of credible abuse complaints, legal notices, or law enforcement requests relating to your service
- Involvement in activities that may result in blacklisting of our IP ranges or network infrastructure
- Non-payment, payment disputes, chargebacks, or fraudulent transactions
- Repeated warnings or unresolved violations following prior notice
Suspension may involve restricted access to your VPS, the client area, and/or associated services. In more serious cases, or where violations are severe, repeated, or unresolved, we may proceed to immediate and permanent termination of the affected service(s).
You acknowledge and accept the following:
- We may take enforcement action without prior warning where urgent action is required to protect our systems or legal interests
- We are under no obligation to retain, recover, or make available any data, snapshots, or configurations following termination or deletion of the VPS
- No refunds, credits, or compensation will be issued for services suspended or terminated due to a breach of this Policy
- Terminated accounts or customers may be denied future access to our services at our sole discretion
We reserve the right to investigate any suspected abuse and to determine, in our sole judgment, whether a violation has occurred. Our decisions in such matters are final.
8. Limitation of Liability; Waiver and Release
All VPS services are provided strictly on an "AS IS" and "AS AVAILABLE" basis. ENVIROWEB LTD makes no warranties, representations, or guarantees of any kind, whether express, implied, or statutory — including, without limitation, any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or system compatibility — to the fullest extent permitted by law.
Without limiting the above, we make no representation or warranty that the VPS services will:
- Meet your specific requirements or expectations
- Operate without interruption, delays, or technical faults
- Be free from errors, vulnerabilities, or security flaws
- Be suitable for any particular outcome, workload, or software environment
You expressly acknowledge that use of the VPS service is entirely at your own risk. Any software, content, or data installed, hosted, accessed, or executed on your VPS is done at your own discretion and responsibility. You assume full responsibility for any resulting damage, loss of access, data corruption, or service degradation.
To the maximum extent permitted by law, we shall not be liable for any of the following:
- Temporary or permanent suspension, interruption, or unavailability of the service
- Loss, corruption, or inaccessibility of data, backups, snapshots, or server content
- Security breaches, intrusions, or exploits resulting from misconfiguration, inadequate security, or customer negligence
- Delays, failures, or degradation caused by external vendors, datacentre providers, or force majeure events
- Unauthorised access due to compromised login credentials or insufficient security measures
- Any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of business, revenue, or data — whether foreseeable or not, and regardless of the legal theory on which the claim is based
We do not monitor or control the content or activity within your VPS environment. As such, we accept no responsibility or liability for the legality, accuracy, security, or integrity of any information transmitted, hosted, or processed via your server.
9. Reservation of Rights
We reserve the right, at our sole discretion and without prior notice, to take any action deemed necessary to protect the integrity of our services, our legal interests, or the stability of our infrastructure. This includes the right to:
- Modify, update, or withdraw the terms, pricing, features, or scope of our VPS services at any time
- Define or enforce usage thresholds, technical limitations, or operational guidelines in order to maintain the health and performance of our systems
- Suspend, restrict, or permanently terminate any service where:
- There is a breach of this VPS Hosting Policy or our Terms of Service
- Payment has not been received or a chargeback has been initiated
- The use of the service causes, or is likely to cause, reputational, operational, or legal harm to ENVIROWEB LTD or its affiliates
- The service is used to harass, threaten, or otherwise abuse our staff, systems, or other users
- The service becomes subject to legal proceedings, takedown requests, or regulatory complaints that create exposure for our business or infrastructure
In addition, we reserve the right to decline to provide or renew service to any individual, organisation, or entity at any time, for any reason, where we reasonably believe such action is necessary to safeguard our operations, comply with legal obligations, or prevent abuse.
10. Amendments and Updates
We may update or amend this VPS Hosting Policy at any time to reflect changes in our services, applicable laws, regulatory requirements, or risk environment. Any modifications will take effect upon being published on our website.
Your continued use of our VPS services after such changes are posted constitutes your acceptance of the updated Policy. If you do not agree to the revised terms, you must discontinue use of the affected services.
